1. Overview

By purchasing floorplans or joinery designs (the "Designs") from Jenn Bliss (the “Company”), you agree to the following Terms and Conditions. These terms apply to all transactions and form a legally binding agreement between you (the "Purchaser") and Jenn Bliss.

2. Intellectual Property and Ownership

2.1 Ownership: The Purchaser acknowledges that all intellectual property rights in the Designs, including but not limited to copyright, trademarks, and patents, remain the sole property of Jenn Bliss.

2.2 License: Upon purchase, the Purchaser is granted a non-exclusive, non-transferable, and non-sublicensable license to use the Designs for personal or commercial use, as specified in the license type selected at the time of purchase. This license does not constitute a transfer of ownership of the Designs.

2.3 Limitations: The Purchaser agrees not to claim ownership of the Designs or to suggest, imply, or assert any rights other than those expressly granted by these terms.

3. Permitted Use

3.1 Personal Use: The Purchaser may use the Designs to construct, modify, or implement for their own personal projects.

3.2 Commercial Use: If a commercial license is purchased, the Purchaser may use the Designs for a single commercial project. The Designs may not be used for multiple projects unless specifically stated in the licensing agreement.

3.3 Restrictions: The Purchaser agrees that they will not:

- Reproduce, copy, or distribute the Designs in any form or by any means, except as expressly permitted by this agreement.

- Resell, sublicense, or redistribute the Designs to any third party, whether in their original form or modified.

- Use the Designs to create derivative works for the purpose of resale or distribution.

4. Prohibited Actions

The Purchaser agrees that they will not:

4.1 Reproduce the Designs for resale, sharing, or distribution, whether digitally or in printed form.

4.2 Upload or distribute the Designs on any online platforms, file-sharing websites, or forums.

4.3 Transfer or assign their rights under these Terms and Conditions to another party without prior written permission from Jenn Bliss.

4.4 Reverse-engineer, decompile, disassemble, or otherwise attempt to recreate or alter the Designs in any way, including converting the content into other formats.

5. Returns and Refunds

Due to the nature of digital products, all sales are final, and refunds will not be issued once the Purchaser has downloaded the Designs. If a Purchaser experiences technical issues with the download, they should contact hello@jennbliss.com within 7 days of purchase.

6. Liability

6.1 Disclaimer of Warranties: The Designs are provided "as is," without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 Limitation of Liability: Jenn Bliss shall not be liable for any damages arising out of the use or inability to use the Designs, including but not limited to construction issues, project delays, or financial losses. In no event shall the liability of Jenn Bliss exceed the amount paid by the Purchaser for the Designs.

7. Enforcement of Rights

7.1 The Purchaser agrees that any unauthorized use, reproduction, or distribution of the Designs constitutes a breach of this agreement and may result in legal action, including but not limited to claims for damages or injunctive relief.

7.2 Jenn Bliss reserves the right to revoke the Purchaser's license at any time if these Terms and Conditions are violated.

8. Governing Law

This agreement is governed by and construed in accordance with the laws of New South Wales. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in NSW, Australia.

9. Modifications

Jenn Bliss reserves the right to modify these Terms and Conditions at any time. Purchasers will be notified of significant changes via email or through updates on the website. Continued use of the Designs following any modification constitutes agreement to the revised terms.

10. Disclaimers

Building Regulations: Always consult with local authorities or a certified architect to ensure these designs meet your area’s building codes.

Structural Modifications: You may need to adapt the design to meet specific site conditions or engineering requirements.

Software Limitations: Floorplans & Elevations are intended for conceptual use only and should not replace detailed architectural or engineering drawings.

11. Additional Protections

11.1 Digital Rights Management (DRM): The Purchaser agrees to take reasonable steps to protect the Designs from unauthorized access, reproduction, or distribution. The Purchaser shall not remove or attempt to bypass any DRM measures or security features applied to the Designs.

11.2 User-Specific Watermarks: The Company reserves the right to include identifiable watermarking or digital fingerprinting in the Designs to trace unauthorized distribution or copying. The Purchaser agrees to keep intact any user-specific watermarks, logos, or identifiers embedded within the Designs.

11.3 Reporting Violations: If the Purchaser becomes aware of any unauthorized use, reproduction, or distribution of the Designs, they agree to promptly notify the Company at hello@jennbliss.com.

11.4 Penalties for Unauthorized Use: Any unauthorized sharing, distribution, or resale of the Designs will result in a penalty of $500 per infringement. This penalty is in addition to any legal remedies available to the Company.
